Jan. 18, 2013: A man is arrested after, a witness says, he takes a gun from an east Houston gas station. Phil Archer reports.

A man was arrested after he went into an east Houston gas station and, a witness said, took a gun from behind a counter.

Houston police said the man walked into the Texaco in the 9100 block of Clinton near Fidelity about 2:15 p.m. on Friday.

Witnesses said the man appeared to be impaired, possibly under the influence of drugs.

A witness said the man walked behind the counter and took a gun.

"He just walked in, walked in the booth and reached down and grabbed the clerk's weapon, put the weapon to his head and pulled the trigger two times," witness John Bowman said. "The weapon didn't go off."

The clerk, Ajit Kumar, said the gun didn't go off because the safety was still on. Kumar said he tried to wrestle the gun away from the man, who he recognized as a regular customer.

"I no like anybody to die in my store," Kumar said. "Everybody has a right to life."

The man and Kumar struggled, but Kumar ended up giving up and ran out of the store.

Kumar said the man fired two gunshots into the ceiling as he left.

Police officers surrounded the store and the man surrendered a short time later. He walked out of the store and laid on the ground. Officers then handcuffed him and took him into custody.
